Komotini Appeals Court sets important construction precedent
A recent Komotini Appeals Court ruling expanded the unconstitutionality of certain provisions in Greece’s New Building Code invalidating a construction permit in Kavala.
The permit, issued in February 2024, nearly doubled the allowable building area through combined incentives, including attic space, energy design bonuses, and uncounted structural elements.
A neighbor successfully challenged the permit, arguing it would degrade the neighborhood.
The court cited prior rulings from the Council of State, asserting that attics –used as primary living space – must count toward total allowable area. It dismissed municipal claims of non-liability and criticized blanket bonuses granted between 2019 and 2022.
The ruling signals a potential judicial shift toward stricter zoning interpretations and may guide future decisions on underground and attic spaces.
