Greece once again ignores the decisions of the ECtHR!
The Court of Cassation once again rejected the request of Turkish Minority Associations to implement the ECtHR judgments and to grant the legal status of the associations.
The Court of Cassation (Arios Pagos) once again rejected the application of the decisions of the European Court of Human Rights (ECHR) regarding the Rhodope Province Turkish Women Cultural Association and Evros Minority Youth Association and the registration of the associations.
The Court of Cassation did not change its stance on the decisions of the ECtHR, which have not been implemented for 15 years for the Evros Minority Youth Association and for 14 years for the Rhodope Province Turkish Women's Cultural Association.
The cases of the Rhodope Province Turkish Women Cultural Association and Evros Minority Youth Association were discussed at the Court of Cassation (Arios Pagos) on October 1, 2021.
The two minority associations reapplied to the domestic law based on the new law adopted in 2017, which allows the implementation of these decisions by Greece to individuals and institutions that have won lawsuits at the ECtHR.
Based on the aforementioned legal regulation, Western Thrace Turkish minority associations filed a lawsuit before the Thrace Court of Appeal for the implementation of the decisions of the European Court of Human Rights regarding minority associations and for the associations to be given their legal status. When the Thrace Court of Appeal rejected the cases, the associations took the cases to the Court of Cassation (Arios Pagos).
Meanwhile, the outcome of the Xanthi Turkish Union case was announced on June 29, 2021, and the Supreme Court once again rejected the request for the legal status of the association to be returned.
