'There is a genuine risk that their basic needs, such as shelter, food, and running water, will not be met, which is a human rights violation,' says Council of State.

A top administrative court in the Netherlands has ruled that the Ministry of Justice and Security cannot send irregular African migrants back to Italy.

“Without reception, there is a genuine risk that their basic needs, such as shelter, food, and running water, will not be met, which is a human rights violation,” the Council of State said in a statement on Wednesday.

The Ministry of Justice and Security refused to accept the asylum applications of two African migrants and wanted to deport them to Italy from where they had come.

On April 11, Italy declared a six-month state of emergency to deal with a surge in the number of migrants arriving in the country via the Mediterranean Sea.

Some 35,000 migrants have arrived so far this year as compared to 8,400 in the same period last year.
