EU approves stricter migrant return rules

The European Council on Thursday gave final approval to new rules aimed at strengthening the return of non-EU nationals who have no legal right to remain in the bloc.

The legislation, which complements the EU’s Pact on Migration and Asylum, establishes common procedures for return decisions and allows member states to set up return hubs in third countries.

Under the new framework, people subject to a return decision will be required to leave the member state concerned and cooperate with national authorities. Those who fail to comply could face measures including reduced benefits, loss of incentives for voluntary return, financial penalties or criminal sanctions where provided for under national law.

The legislation also introduces a European Return Order containing key elements of national return decisions. The mechanism is intended to facilitate recognition of return decisions across EU member states, although mutual recognition will initially remain voluntary.

The system will be reviewed three years after the rules enter into force. The European Commission could then propose legislation making recognition mandatory.

Tougher measures for security risks

The new rules provide additional measures for non-EU nationals considered to pose a security risk.

Member states may impose an indefinite entry ban when justified and proportionate to the risk involved. They may also detain such individuals for longer than 24 months under conditions set out in the regulation.

Return hubs outside the EU

Member states will also be able to transfer people subject to return decisions to return hubs in non-EU countries, provided an agreement or arrangement has been reached with the country concerned.

The EU said such agreements may only be concluded with countries that respect international human rights standards and international law, including the principle of non-refoulement.

Unaccompanied minors are excluded from return hub arrangements.
